Identification

Cuchy Spain, with CIF B01738913 and registered office in Madrid-Spain, is the owner of this website, and with whom any purchase would be contracted according to the terms and conditions expressed below.

Object

The purpose of this section is to define the terms and conditions of purchase on commercial transactions made in our store www.cuchy.es, domain operated by Cuchy Spain.

These terms and conditions, together with your order confirmation, constitute the contract between CUCHY.ES and the customer for the supply of products. It will be understood that the customer agrees to the general conditions provided for in this text from the moment he/she accepts that he/she has read and agrees to these Terms and Conditions.

Formalization of orders

For the formalization of an order the following steps will be followed:

  • Incorporate the selected product or products in the "shopping cart".
  • Fill in the required "SHIPPING / INVOICING DATA" section. The "ADDITIONAL COMMENTS" field is intended to include any comments deemed appropriate in order to clarify any matter related to the delivery or order.
  • Select (if there are several options) a shipping method and a payment method.
  • Accept these "Terms and Conditions".
  • Complete the payment on the selected or default payment gateway.
  • If the order has been successfully processed, the Customer will receive an order confirmation email with an order reference code in his/her email account.
  • Cuchy reserves the right to cancel any order and refund the full amount of the order to the customer as soon as possible, for justified reasons to the company.

 

Contents and information of the website

CUCHY.ES reserves the right to modify at any time the commercial conditions presented on its website regarding prices, promotions or discounts. It is recommended that users who have made a purchase previously review these terms and conditions of contract in case they have undergone any modification.

In the cases in which some information or typographical error occurs on the website, at all times beyond the control of CUCHY.ES, we will proceed immediately to correct it. If any such error would have caused an erroneous purchase decision, CUCHY.ES will inform the customer of the error and the customer will have the right to cancel the purchase without any cost on their part.

The photographs respect as much as possible the essence of the product itself, but may cause differences in tone or finish due to the nature of the wood with which we manufacture our products. For this reason, CUCHY.ES is not responsible for any differences that may exist between the product shown and the original product as a result of the characteristics of the wood.

Prices and taxes

The prices of the products displayed in the online store include Value Added Tax (VAT) and shipping costs. *Excluding the Canary Islands, Ceuta and Melilla, where VAT and free shipping do not apply.

 

Methods of payment

Purchases can be paid by

  • Credit or debit card
  • Paypal
  • Express payment methods with Shop Pay, Google Pay or Paypal
  • Payment by bank transfer
  • Cash on delivery payment
The cash on delivery payment method has an associated cost of 12 €, to be able to choose this payment method, you must choose the shipping method "Home delivery - Cash on delivery". If you place an order with the cash on delivery payment method, and you have not chosen this payment method, we will not be able to send your order.

All these payment solutions are completely secure. Orders will be processed as soon as the payment is validated.

The buyer's bank details will not be kept under any circumstances.

Coupons are not cumulative and do not apply during the sales season.

Shipping method, costs and delivery times

Orders will be delivered to the address indicated on the order form, so CUCHY.ES assumes no responsibility when the delivery can not be made as a result of the data provided are not correct, are inaccurate or incomplete.

Orders that appear as >PRE-ORDER<, means that at this time we do not have that item in our warehouse, and will be delivered in the shortest possible time, both in the product sheet (when the customer selects the size) and in the purchase summary indicates that an order is PRE-ORDER.

PRE-ORDER orders are charged at the time of purchase.

The customer agrees to enable the delivery of the ordered order by providing a delivery address to which the ordered order can be delivered within the usual delivery schedule of goods. In case of non-compliance by the customer of this obligation, CUCHY.ES shall have no liability for the delay or inability to deliver the order.

In the case of not being able to start the processing of the order because the requested product is not available, the buyer will be promptly informed of this incident, with the commitment to solve it as soon as possible.

Under the legislation on Land Transport Management, it is up to the customer to verify the products upon receipt and expose all the caveats and claims that may be justified in the document of receipt of delivery.


Order shipping

  • Shipping costs are included in the price of the product from 100€ in: Spain peninsula.
  • Shipping costs to CEUTA AND MELILLA are 19€.
  • Shipping costs to FRANCE are 20€.
  • Orders will be delivered by GLS courier service within 24/48 working hours.


In cases where it is not possible to deliver the order, a second delivery attempt will be made free of charge. If after this second attempt the delivery of the order is not possible either, the customer may contact the courier agency at the telephone number indicated in the sms he/she will receive from the agency at the moment of initiating the shipping process.

Customs costs are not included in the price and must be paid by the buyer. Cuchy is not responsible for the costs of customs duties and customs clearance that each country or city has to apply.


Warranty

In compliance with the General Law for the Defense of Consumers and Users, the warranty against manufacturing defects is 24 months. This warranty includes the replacement of an identical product, as well as the transport costs corresponding to the new shipment and those derived from the return of the defective product.

The warranty does not include defects or flaws due to incorrect use or handling of the material or wear and tear caused by normal use.

The processing of the warranty must be requested by email to INFO@CUCHY.ES and within 72 HOURS a person responsible for the website will contact the customer to initiate the process.

Returns

To proceed with the return of an item purchased in the online store, you must request it through an email to info@cuchy.es within a period not exceeding 14 calendar days from receipt of the product, letting us know as long as the buyer so wishes the reason for the return. The date of the delivery receipt will be used for the purpose of calculating the deadline.

Products that have been customized at the request of the customer will not be returned unless they are defective products.

Cuchy will cancel any return where the product is not in optimal conditions for its subsequent sale, it is understood as used sole, scratched, stains in sole, sole, material, ornaments and leather, returns will not be accepted with more than 15 days from the purchase of the product.

Returns can be processed as follows:

Communicating by mail to info@cuchy.es the intention and reason for returning the product. In this case a person in charge of the website will contact the buyer to process the return process.

Sending the product to Cuchy Spain with address in Avenida de la Industria 14 28823 Coslada. The shipping method will be managed with the agreed transport company. It must be returned in its original condition, along with any accessories related to them, not being able to be used, washed or damaged.

Returns that do not comply with our policy will not be accepted and returned to the customer. They must keep their original labels, their complete original packaging and attach the invoice or a copy of it in case of returning part of the order.

In case of return, the shipping costs will be borne by the buyer, except when the purchase is subject to a free return promotion that affects the return for the change of size of one or more items.

In case a product has some kind of damage or is in an incorrect state, the company will assume all the costs of collecting the product, as well as the shipping of the new one to the customer.

All orders can be cancelled, with or without justified cause within 14 calendar days after receipt of the order. Provided that the product is in perfect condition and in the original packaging.

IMPORTANT NOTE: Until we receive the item in our warehouse it is your responsibility. We recommend that you send the item to us by registered mail and that you keep the proof of postage.

Once the package arrives at Cuchy, it will be examined to verify that it is suitable for sale and we will then proceed to send a confirmation email to the customer indicating the refund.

When trying on shoes, please note that you should not scratch the soles or mark the shoe box.

Returns must also include the box, as it is considered part of the product. Place the shoe box inside another box to avoid damage during shipping.

By exception, the right of withdrawal does not apply in the case of products manufactured according to customer specifications or clearly personalized products which, due to their nature, cannot be returned to the manufacturer.

Upon receipt of the returned product will proceed, WITHIN A MAXIMUM OF 14 DAYS, to the refund of the amount in the same form of payment used in the purchase.

Obligations of the buyer

The buyer is committed to provide truthful information about the data requested in the user registration forms or order placement.


Applicable law and competent jurisdiction

These Terms and Conditions shall be interpreted in accordance with the legislation in force. In the event of any conflict or discrepancy arising in the interpretation or application of these Terms and Conditions, the provisions of the applicable law regarding competent jurisdiction shall apply.

In all cases, both parties submit, expressly waiving any other jurisdiction, to the Courts and Tribunals of Madrid.


Data protection

Cuchy Spain, domiciled in MADRID is responsible for the processing of personal data provided during the purchase process in order to manage the contractual relationship, serve the orders received, proceed to billing and collection, as well as send information on the status of the order and address returns and complaints. Such treatment is carried out because it is necessary to comply with the contractual relationship established with the purchase and the existence of a legitimate interest of the company in keeping you informed in the case of sending commercial information about similar products.

In the case of providing data of third parties to indicate the shipping address, you must do so with their consent.

Your data will be provided to the transport company to proceed with the shipment and to the Tax Agency if necessary for the fulfillment of tax obligations. In the case of a claim, information will be provided to the corresponding Consumer Attention Office.

The data will be kept as long as necessary to meet the responsibilities arising from the purchase.

You also have the following rights:

  • Access to your data obtaining confirmation as to whether or not they are being processed.
  • The rectification of those that are incomplete or inaccurate.
  • The deletion of your data when it is not necessary, it is established by law, you withdraw your consent or you oppose to the treatment, among other reasons.
  • Opposition to processing for reasons based on your personal circumstances, in which case once these reasons have been analyzed they will no longer be processed, or at your simple request in the event that your data were being processed for promotional purposes.
  • The limitation of the treatment while it is assessed whether the attention of other rights, opposes their deletion, or want them to be kept for the exercise or defense of their claims.
  • Data portability to obtain in electronic format the personal data that you have provided us and those that we have obtained during your relationship with the company.
  • To not be subject to automated individual decisions to challenge any decision that you understand may affect your rights and freedoms or legitimate interests and that was based on an automated decision, including profiling. You may request the exercise of these rights by sending an email to INFO@CUCHY.ES providing a copy of your identity document and indicating your name and surname(s), an address for notification purposes and the right you wish to exercise. You can also withdraw your consent for the processing for which it would have been necessary or file a complaint with the Spanish Data Protection Agency (AEPD) if you consider that the processing of your data does not comply with the law.
